Terms of Sales

These conditions of sale are concluded:

on the one hand by the association "Memory and Database" having as legal representative the president of this one, hereinafter called "the association"

and on the other hand, by any natural or legal person wishing to make a purchase via the website of the "association" hereinafter called "the buyer".

Object

These conditions of sale are intended to define the contractual relations between the association and the buyer and the conditions applicable to any purchase made through the association's merchant site, whether the buyer is professional or consumer.

The acquisition of a good or a service through this site implies an unconditional acceptance by the buyer of these conditions of sale.

These conditions of sale will prevail over any other general or specific conditions not expressly approved by the association.

The association reserves the right to modify its conditions of sale at any time. In this case, the applicable conditions will be those in force on the date of the order by the buyer.

Characteristics of the goods and services offered

The products and services offered are those listed in the catalog published on the association's website.

These products and services are offered while stocks last.

Each product is accompanied by a description.

The photographs in the catalog are as faithful as possible but cannot ensure perfect similarity with the product offered, particularly with regard to colors.

Prices

The prices appearing in the catalog are prices including VAT in euros taking into account the VAT applicable on the day of the order; any change in the rate may be reflected in the price of the products or services.

The association reserves the right to modify its prices at any time, it being understood that the price appearing in the catalog on the day of the order will be the only one applicable to the buyer.

The prices indicated do not include the costs of order processing, transport and delivery provided that they take place in the geographical areas provided below.

Geographical area

The online sale of products and services presented on the site is reserved for buyers who reside in France, the French overseas departments and territories, Germany, Luxembourg, Netherlands, Switzerland, Belgium, Canada, the United States, Great-Britain and for deliveries required in these geographic areas.

Orders

The buyer, who wishes to buy a product or service must:

- complete the billing form on which he will indicate all the contact details requested or identify himself using his identifiers on the association's website;

- complete the online order form giving all the references of the products or services chosen;

- validate the order after having checked it;

- make the payment under the conditions provided;

- confirm the order and payment.

The confirmation of the order implies acceptance of these conditions of sale, the recognition of having perfect knowledge of it and the renunciation to avail oneself of its own conditions of purchase or other conditions.

All the data provided and the confirmation recorded will constitute proof of the transaction. Confirmation will be worth signing and acceptance of transactions.

The association will send confirmation of the order placed by email.

Withdrawal

Buyers, non-professional individuals, have a withdrawal period of seven days from the delivery of their order to return the product to the seller for exchange or refund without penalty, except for return costs. This withdrawal period concerns only material goods (in particular books printed on paper), but does not concern intangible goods (in particular electronic books, also called e-books) because the return of the product to the association loses its meaning and in no way prevents the buyer from making a copy of the file and keeping it.

Payment terms

The price is due upon order.

Payments will be made by Paypal or bank card through Prestashop Checkout according to the customer's choice; these systems use the SSL (Secure Socket Layer) protocol so that the information transmitted is encrypted by software and that no third party can become aware of it during transport over the network.

The buyer's account will be debited upon confirmation of the order of the products or services available and the amount of the products or services sent or downloaded.

At the buyer's request, a paper invoice showing VAT will be sent to him.

Deliveries

Deliveries are made to the address indicated in the invoice, which can only be in the agreed geographical area.

The risks are borne by the buyer from the moment the products have left the premises of the association. In the event of damage during transport, the reasoned protest must be made to the carrier within three days of delivery.

Delivery times are given for information only; if these exceed thirty days from the order, the sales contract may be terminated and the buyer reimbursed.

Guarantee

All products supplied by the seller benefit from the legal guarantee provided for in articles 1641 and following of the Civil Code.

In case of non-conformity of a product sold, it can be returned to the seller who will take it back, exchange it or reimburse it.

All complaints, requests for exchange or reimbursement must be made by post to the following address: Association Mémoire et Database 12 rue marguerite Besnard 50770 Valognes within thirty days of delivery.

Responsibility

The association, in the online sales process, is bound only by an obligation of means; its responsibility could not be engaged for a damage resulting from the use of the Internet network such as loss of data, intrusion, virus, breakdown of the service, or other involuntary problems.

Intellectual property

All elements of the association's site are and remain the intellectual and exclusive property of the association.

No one is authorized to reproduce, exploit, redistribute, or use for any reason whatsoever, even partially, elements of the site, whether software, visual or audio.

Any simple link or hypertext is strictly prohibited without the express written agreement of the association.

Personal data

In accordance with the law relating to data processing, files and freedoms of January 6, 1978, information of a nominal nature relating to buyers may be subject to automated processing.

The association reserves the right to collect information on buyers, including by using cookies, and, if it wishes, to transmit the information collected to commercial partners.

Buyers can object to the disclosure of their details by notifying the association. Likewise, users have the right to access and rectify data concerning them, in accordance with the law of 6 January 1978.

Archiving - Proof

The association will archive purchase orders and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of article 1348 of the Civil Code.

The association's computerized registers will be considered by the parties as proof of communications, orders, payments and transactions between the parties.

Litigation

These online sales conditions are subject to French law.

In the event of litigation, competence is allotted to the competent courts of Cherbourg, notwithstanding plurality of defendants or call in guarantee.
